1. Introduction
Welcome to Masjidkit! By using our services, you agree to comply with and be bound by the following terms and conditions. Please review the following terms carefully. If you do not agree to these terms, you should not use our services.
Masjidkit provides a platform specifically designed to help mosques create a well-designed "landing page". This landing page is a site that presents all relevant information to congregants (e.g. daily prayer times; Friday prayer schedules; updates through a news feed; and more).
By accessing or using any part of the Masjidkit service, whether as an administrator or a general user, you agree to be bound by these Terms of Service. These terms apply to all users of the site, including but not limited to administrators, visitors, and contributors of content. Your acceptance of these terms is legally binding, and an electronic acceptance or continued use of the service shall have the same force and effect as a written signature. This agreement encompasses all interactions with Masjidkit services, including account creation, content submission, and general use of the platform.
Please read these Terms of Service carefully before accessing or using our website. Your access to and use of the service is conditioned upon your acceptance of and compliance with these terms. If you disagree with any part of the terms, then you may not access the service.
Masjidkit reserves the right to update and change these Terms of Service from time to time without notice. Any new features that augment or enhance the current service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the service after any such changes shall constitute your consent to such changes.
2. Definitions
- Landing page: A site generated by Masjidkit that provides relevant information to congregants, including daily prayer times, Friday prayer schedules, and updates through a news feed.
- Administrator: An individual who creates and manages an account on Masjidkit for the purpose of creating and/or updating any information associated with the mosque.
- User: Any person who accesses and uses Masjidkit (or any of it's services). This includes administrators and visitors who access any of the generated landing pages.
- Content: All information, text, images, and other materials uploaded to or displayed on the Masjidkit platform or its generated landing pages.
- Service: The Masjidkit platform and all related tools, resources, and services provided by Masjidkit.
- Account: The account created by an administrator to access and use the Masjidkit platform and services.
- Terms: The terms and conditions outlined in this Terms of Service document.
- Privacy Policy: The document outlining how Masjidkit collects, uses, and protects users' personal information.
- Google Map’s Places API: A service provided by Google that allows Masjidkit to identify and display mosque locations as specified by administrators.
- Dispute: Any disagreement, controversy, or claim arising out of or relating to the use of Masjidkit services, these Terms of Service, or the rights and obligations of the parties involved. This includes any disputes regarding the interpretation, breach, termination, validity, or enforceability of these terms.
- Arbitration: A method of resolving disputes outside the court system where an impartial third party (the arbitrator) reviews the evidence and arguments presented by the parties involved and imposes a decision that is final and legally binding. Arbitration is intended to be a faster and less formal alternative to litigation.
- Force Majeure: Any event or circumstance beyond the reasonable control of either party that prevents them from performing their obligations under these Terms of Service. This includes, but is not limited to, natural disasters (such as earthquakes, floods, and hurricanes), acts of war or terrorism, civil unrest, labor strikes, and governmental actions or orders.
3. Account Creation and Management
3.1. Eligibility Requirements
To create an account on Masjidkit, users must meet the following criteria:
- Legal Compliance: Users must fulfill all legal requirements in their local jurisdiction (e.g. attaining the age of majority) to be legally bound by these terms.
- Authorization: Users must be authorized to create an account on behalf of a mosque. No user may create a landing page for a mosque without attaining written authorization.
3.2. Responsibilities of Account Holders
By creating an account, administrators agree to:
- Accurate Information: Maintain accurate and up-to-date information for their account and the mosque they represent. Providing false or misleading information, whether intentionally or unintentionally, may result in immediate suspension or termination of your account, and potential legal action. Users are encouraged to periodically review and update their information to avoid any discrepancies.
- Security: Ensure the security and confidentiality of their account credentials. Administrators are responsible for all activities that occur under their account.
- Compliance: Comply with all applicable laws and regulations while using the Masjidkit platform. Failure to comply with these legal requirements can result in severe consequences, including legal action, fines, and the immediate termination of services. Masjidkit reserves the right to report any violations to the appropriate authorities.
- Adherence to Terms: Use the Masjidkit platform strictly in accordance with these Terms of Service and any other policies or guidelines provided by Masjidkit.
- Appropriate Use: Ensure that the platform is used solely for the intended purpose of managing mosque communications and community updates.
3.3. Account Security and Responsibility
- Password Security: Administrators must use strong, unique passwords for their accounts and are responsible for maintaining the confidentiality of their passwords.
- Unauthorized Access: Administrators must immediately notify Masjidkit of any unauthorized use of their account or any other breach of security.
- Activity Monitoring: Administrators should regularly monitor their account activity and take appropriate steps to protect their account from unauthorized access.
4. Use of the Service
4.1. Description of the Services Provided
Masjidkit provides a platform that allows mosques to create and manage a "landing page". This includes tools and features for updating prayer times, Friday prayer schedules, and other community announcements. The service is designed to facilitate seamless communication between mosque administrators and congregants.
4.2. Permitted and Prohibited Uses
Permitted Uses:
- Administrators may use the platform to manage and update their mosque's landing page, including posting prayer times, schedules, and community updates. Users may access and view information displayed on the landing page. Any other use requires prior written consent from Masjidkit.
- Examples of permitted uses include:
- Posting accurate and relevant information about mosque activities.
- Sharing updates on community events and announcements.
- Engaging with congregants through provided communication tools in a respectful manner.
Prohibited Uses:
- Any use of the platform that is unlawful, unauthorized, or violates these Terms of Service is strictly prohibited.
- This includes, but is not limited to:
- Posting or transmitting content that is harmful, offensive, defamatory, or violates any third-party rights.
- Using the platform to distribute malware, spam, or engage in any form of harassment.
- Interfering with the operation or security of the platform, including attempts to hack or disrupt service.
- Using the platform for commercial purposes without explicit permission from Masjidkit.
Consequences for engaging in prohibited actions include immediate suspension or termination of your account, legal action, and potential financial penalties. Masjidkit reserves the right to report any violations to the appropriate authorities.
4.3. User Responsibilities and Conduct
- Compliance: Users must comply with all applicable laws and regulations while using the service.
- Content Accuracy: Administrators are responsible for ensuring that the information they provide on the landing page is accurate and up-to-date.
- Prohibited Conduct: Users must not engage in any conduct that could harm the platform, its users, or its reputation. This includes, but is not limited to, the distribution of malware, spamming, and harassment.
- Reporting Violations: Users are encouraged to report any violations of these terms or suspicious activities to Masjidkit support.
5. Content and Intellectual Property
5.1. User-Generated Content
5.1.1. Your Materials
- License to Masjidkit: Masjidkit does not claim ownership of the materials you provide; however, we require a license to those materials. By uploading or submitting content to Masjidkit, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and license to host, use, distribute, modify, run, copy, store, publicly perform, communicate, broadcast, reproduce, display, translate, and create derivative works of any materials provided by you in connection with the services. This license allows us to operate, provide, and promote the services and fulfill our obligations under the Terms of Service. You represent, warrant, and agree that you have all necessary rights in the materials to grant this license. You irrevocably waive any moral rights you may have in the materials in favor of Masjidkit.
- Ownership Retention: If you owned the materials before providing them to Masjidkit, they remain yours even after uploading them to your landing page, subject to the rights and licenses granted in the Terms of Service. You can remove your content at any time by deleting your account. Removing your content does not terminate any rights or licenses granted to Masjidkit during the term of service.
- Review and Deletion: You agree that Masjidkit can review and delete any or all of the materials submitted to the services, although Masjidkit is not obligated to do so.
- Use of Trademarks: You grant Masjidkit a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and license to use the names, trademarks, service marks, and logos associated with your landing page to operate, provide, and promote the services and to fulfill our obligations under the Terms of Service. This license will survive any termination of the Terms of Service solely to the extent that Masjidkit requires the license to exercise any rights or perform any obligations that arose during the term.
5.2. Masjidkit Intellectual Property
- Use of Trademarks: You agree that you may not use any trademarks, logos, or service marks of Masjidkit, whether registered or unregistered, including but not limited to the word mark MASJIDKIT, without our prior written authorization. You agree not to use or adopt any marks that may be considered confusing with the Masjidkit trademarks. Any variations or misspellings of the Masjidkit trademarks would be considered confusing with the Masjidkit trademarks.
- Restrictions on Use: You agree not to purchase, register, or use search engine or other pay-per-click keywords (such as Google Ads), trademarks, email addresses, social media names, or domain names (including without limitation top-level domains, sub-domains, and page URLs) that use or include Masjidkit or Masjidkit trademarks or that use or include any terms that may be confusing with the Masjidkit trademarks.
- No Patent Rights: You acknowledge and agree that the Terms of Service do not give you any right to implement Masjidkit patents.
5.3. Ownership of Content
- Masjidkit Content: All content provided by Masjidkit, including but not limited to text, graphics, logos, images, and software, is the property of Masjidkit or its content suppliers and is protected by international copyright laws. Users are granted a limited, non-exclusive, and revocable license to use the content for personal and non-commercial purposes in connection with the use of the service.
5.4. Rights to Modify or Remove Content
- Modification and Removal: Masjidkit reserves the right to modify, remove, or refuse to display any content at its sole discretion. This includes content that violates these Terms of Service, infringes on any third-party rights, or is otherwise deemed inappropriate or harmful to the platform and its users.
5.5. Intellectual Property Rights
- Trademarks: All trademarks, service marks, and trade names used on the Masjidkit platform are the property of their respective owners. Users are prohibited from using any trademarks, service marks, or trade names without the prior written consent of the respective owners.
- Copyright: All content on the Masjidkit platform is protected by copyright law. Unauthorized use, reproduction, or distribution of the content is strictly prohibited and may result in civil and criminal penalties.
- Infringement Claims: If you believe that your intellectual property rights have been infringed upon by content on the Masjidkit platform, please contact us with a detailed description of the alleged infringement and any supporting documentation.
5.6. Prohibition of Data Exploitation
- Prohibited Actions:
- Scraping: Users are prohibited from scraping, data mining, or using any automated means to access, retrieve, or collect data from the platform without the prior written consent of Masjidkit.
- Crawling: Crawling the platform using bots, spiders, or any automated methods is strictly prohibited.
- Harvesting: Users may not harvest email addresses, contact information, or any other personal data from the platform for any purpose.
- Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any part of the platform's software or services is prohibited.
- Data Extraction Tools: The use of tools or software that extract data from the platform, such as data extraction tools, screen scraping tools, or data analytics tools, without express permission is prohibited.
- Automated Querying: Automated querying, including the use of query bots or similar methods to conduct multiple queries simultaneously or at a rapid pace, is prohibited.
- Unauthorized Access: Gaining unauthorized access to the platform's data, servers, or networks, or attempting to bypass security measures, is strictly prohibited.
- Content Aggregation: Users are prohibited from aggregating, consolidating, or reproducing data or content from the platform for any commercial or non-commercial purpose without explicit written consent.
- Data Reproduction: Reproducing, distributing, or publicly displaying data or content obtained from the platform in any form without authorization is prohibited.
- Scope of Prohibitions: The aforementioned prohibitions are not exhaustive. Any other methods used to exploit or extract data from Masjidkit are also prohibited without prior written approval. Masjidkit reserves the right to deny or revoke any permissions at its sole discretion.
- Consequences of Violations: Violations of these prohibitions may result in immediate suspension or termination of user accounts. Masjidkit reserves the right to pursue legal action against individuals or entities that violate these prohibitions. Any unauthorized use of data may also result in financial penalties and compensation for damages incurred by Masjidkit.
- Reporting Violations: Users are encouraged to report any suspected violations of these prohibitions to Masjidkit support. Reports will be investigated, and appropriate action will be taken.
6. Service Availability and Modifications
6.1. Availability of the Service
- Service Continuity: Masjidkit aims to provide continuous access to the platform and its services. We are committed to ensuring high availability and reliability for all users.
- Commitments: Masjidkit will make specific availability commitments only to mosques with whom we have explicit agreements. These commitments will be detailed in separate service level agreements (SLAs).
6.2. Right to Modify or Discontinue the Service
- Modification of Services: Masjidkit reserves the right to modify, update, or discontinue any part of the service at any time. This includes adding or removing features, changing service offerings, or altering the user interface.
- Discontinuation: Masjidkit may discontinue the service or any part thereof, permanently or temporarily, at our sole discretion, with or without notice. Users agree that Masjidkit shall not be liable to them or any third party for any modification, suspension, or discontinuance of the service.
6.3. Maintenance and Updates
- Scheduled Maintenance: Masjidkit may perform scheduled maintenance on the platform, which may require temporary downtime. Users will be informed in advance of any scheduled maintenance that may affect service availability.
- Emergency Maintenance: In cases of emergency maintenance, service may be temporarily unavailable without prior notice. Masjidkit will work to resolve such issues as quickly as possible.
- Updates and Upgrades: Masjidkit may release updates, upgrades, and patches to enhance or improve the platform. Users agree to receive such updates as part of their use of the service.
7. Termination and Suspension
7.1. Conditions for Terminating or Suspending Accounts
- Violation of Terms: Masjidkit reserves the right to suspend or terminate any account that violates these Terms of Service, engages in fraudulent or illegal activities, or otherwise poses a risk to the integrity of the platform.
- Failure to Comply: Accounts may be terminated or suspended if users fail to comply with any applicable laws, regulations, or these Terms of Service.
- Inactive Accounts: Masjidkit reserves the right to terminate accounts that have been inactive for an extended period of time.
7.2. Effects of Termination
- Loss of Access: Upon termination or suspension, users will lose access to their accounts and all associated data. Users are responsible for backing up their data to prevent loss.
- Data Retention: Masjidkit may retain certain information from terminated accounts as required by law or for legitimate business purposes.
- Outstanding Payments: Termination of an account does not absolve users from any outstanding payment obligations. Users agree to settle any unpaid fees promptly.
7.3. User's Right to Terminate
- Voluntary Termination: Users may terminate their accounts at any time by contacting Masjidkit support. Upon termination, users will lose access to their accounts and all associated data.
- Refunds: Refunds for terminated accounts will be handled in accordance with Masjidkit's refund policy.
7.4. Reinstatement of Accounts
- Appeal Process: Users whose accounts have been suspended or terminated may appeal the decision by contacting Masjidkit support. Appeals will be reviewed on a case-by-case basis.
- Reinstatement Conditions: Reinstatement of suspended or terminated accounts may be subject to certain conditions, such as compliance with these Terms of Service and any additional requirements set by Masjidkit.
8. Disclaimers and Limitations of Liability
8.1. General Disclaimers
- As-Is Service: Masjidkit provides the platform and services on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the operation of the service or its content, except as specifically outlined in our explicit agreements with users.
- User-Generated Content: The accuracy and reliability of information provided through the community hub are the responsibility of the administrators who manage the content. Masjidkit does not guarantee the accuracy or reliability of user-generated content.
8.2. Limitation of Liability
- No Liability for Damages: To the fullest extent permitted by law, Masjidkit, its affiliates, officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the service.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the service.
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the service by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service.
8.3. No Warranties
- Express Disclaimers: Masjidkit expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as specifically outlined in our explicit agreements with users.
- Third-Party Services: Masjidkit makes no warranty or representation regarding any third-party services or products that may be integrated or used in conjunction with the service. Users assume all responsibility and risk for the use of any third-party services.
8.4. Exclusions and Limitations
- Jurisdictional Limits: Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, Masjidkit's liability will be limited to the fullest extent permitted by law.
- Maximum Liability: In no event shall Masjidkit's aggregate liability exceed the amount paid by you, if any, for accessing or using the service during the twelve (12) months preceding the event giving rise to the claim.
8.5. Indemnification
- User's Agreement: Users agree to indemnify, defend, and hold harmless Masjidkit, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the service.
- Your violation of any term of these Terms of Service.
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
- Any claim that your content caused damage to a third party.
8.6. Third-Party Links and Services
- Disclaimer: The service may contain links to third-party websites or services, including embedded content, and social media integrations, that are not owned or controlled by Masjidkit. Masjidkit has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
- User Responsibility: You acknowledge and agree that Masjidkit shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. Users are responsible for reading and agreeing to the terms and conditions and privacy policies of any third-party websites or services they interact with through the Masjidkit platform.
- Examples of Third-Party Interactions: Examples of third-party interactions include, but are not limited to:
- Links to external websites for additional information or resources.
- Embedded videos, images, or articles from third-party sites.
- Social media sharing features and links.
- Changes to Third-Party Services: Third-party websites or services linked to or integrated with the Masjidkit platform may change without notice. Masjidkit is not responsible for any changes, updates, or unavailability of such third-party services.
9. Changes to the Terms of Service
9.1. Right to Update or Modify the Terms
- Authority to Amend: Masjidkit reserves the right to update, modify, or replace any part of these Terms of Service at any time. Such changes will be effective immediately upon posting to the Masjidkit website.
- Scope of Changes: Changes may include, but are not limited to, updates to the terms, the introduction of new policies, or modifications to existing services and features.
9.2. Notification of Changes
- User Notification: We will provide notice of any material changes to these Terms of Service by posting the updated terms on our website. Users are encouraged to review the terms periodically to stay informed of any changes.
- Effective Date: The effective date of any changes will be indicated at the top of the updated Terms of Service document. Continued use of the service after the effective date constitutes acceptance of the changes.
9.3. User's Responsibility to Review Changes
- Regular Review: It is the responsibility of users to regularly review the Terms of Service to ensure their awareness of any modifications.
- Acceptance of Changes: By continuing to access or use the service after the updated terms are posted, users agree to be bound by the revised Terms of Service. If a user does not agree to the new terms, they must discontinue use of the service.
10. Governing Law and Jurisdiction
10.1. Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms of Service and is hereby expressly excluded.
10.2. Jurisdiction
The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Province of Ontario with respect to any dispute or claim arising out of or in connection with the Terms of Service or their subject matter or formation (including non-contractual disputes or claims).
10.3. Online Dispute Resolution
For users located in the European Union, you may also refer disputes to the European Commission Online Dispute Resolution platform, which can be found at https://ec.europa.eu/consumers/odr.
10.4. Mandatory Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms of Service, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the International Chamber of Commerce. The seat of arbitration shall be Ottawa, Ontario, Canada.
- Arbitration Costs: Both parties shall share the arbitration costs equally, and each party shall be responsible for their own legal fees and expenses unless the arbitrator determines that the claim was frivolous or brought in bad faith, in which case the arbitrator may award costs and fees to the prevailing party.
- Limitation on Arbitrator's Authority: The arbitrator shall have no authority to award punitive or exemplary damages, and the parties expressly waive their rights to seek or recover any such damages in arbitration. The arbitrator's award shall be limited to compensatory damages actually incurred and supported by evidence.
- Confidentiality: The arbitration proceedings, including all documents and information disclosed in the course of the arbitration, shall be kept strictly confidential by the parties and the arbitrator. Neither party shall disclose the existence, content, or results of the arbitration without the prior written consent of the other party, except as required by law or for purposes of enforcement of the arbitration award.
- Interim Relief: Either party may seek interim or provisional relief from a court of competent jurisdiction in Ottawa, Ontario, Canada, if necessary, to protect its rights or property pending the completion of arbitration. The request for such interim relief shall not be deemed incompatible with, or a waiver of, this agreement to arbitrate.
- Time Limitation: Any claim arising out of or relating to these Terms of Service must be filed within ninety (90) days after such claim arose; otherwise, the claim is permanently barred. This limitation period shall be tolled during the duration of any negotiation, mediation, or arbitration under these Terms of Service.
- Class Action Waiver: The parties agree that any arbitration shall be conducted solely in their individual capacities and not as a class action or other representative action. The parties expressly waive their right to file a class action or seek relief on a class basis.
- Arbitrator Selection: The arbitrator shall be selected by mutual agreement of the parties. If the parties cannot agree on an arbitrator within thirty (30) days, the International Chamber of Commerce shall appoint the arbitrator.
- Maximum Liability: In any arbitration, the maximum amount of damages that may be awarded against Masjidkit, regardless of the form of action or basis of the claim, shall be limited to the total fees paid by the user to Masjidkit for the services during the twelve (12) months preceding the event giving rise to the claim.
10.5. Severability
If any provision or part of a provision of these Terms of Service is found to be invalid, illegal, or unenforceable, that provision or part-provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms of Service.
10.6. Notification of Disputes
In the event of a dispute, you agree to provide Masjidkit with a written notice of the dispute, including a brief description of the dispute, the relief sought, and your contact information. You must send any such notice via email to support@masjidkit.com. Masjidkit will make good faith efforts to resolve the dispute informally.
11. Force Majeure
- Non-Liability for Failure to Perform: Masjidkit shall not be liable for any failure to perform its obligations under these Terms of Service if such failure results from circumstances beyond Masjidkit's reasonable control, including but not limited to:
- Acts of God (e.g., earthquakes, floods, hurricanes, and other natural disasters)
- War, terrorism, or acts of public enemies
- Labor disputes, strikes, or lockouts
- Governmental actions, orders, or laws
- Interruptions in internet or communications services
- Fire, explosions, or other casualties
- Any other events or circumstances beyond the reasonable control of Masjidkit
- Mitigation of Effects: The affected party shall use reasonable efforts to mitigate the effects of the force majeure event and resume performance of its obligations as soon as possible.
- Extension of Time: The time for performance of obligations shall be extended for the duration of the force majeure event. If the force majeure event continues for more than ninety (90) days, either party may terminate the agreement upon written notice to the other party.
- Payment Obligations: Force majeure does not excuse payment obligations unless explicitly stated. Neither party shall be liable for any damages resulting from a force majeure event.
12. Waiver
- No Waiver of Rights: The failure or delay of Masjidkit to exercise or enforce any right, remedy, or provision of these Terms of Service shall not constitute a waiver of such right, remedy, or provision, nor shall it affect the ability of Masjidkit to enforce such right, remedy, or provision at any time thereafter.
- Written Waiver Required: Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by an authorized representative of Masjidkit. A written waiver by Masjidkit of any default, breach, or non-compliance of these Terms of Service shall not be a waiver of any subsequent default, breach, or non-compliance.
- Non-Continuing Waiver: No waiver of any term, provision, or condition of these Terms of Service, whether by conduct or otherwise, in any one or more instances, shall be deemed to be or construed as a further or continuing waiver of any such term, provision, or condition, or of any other term, provision, or condition of these Terms of Service.
- Cumulative Rights and Remedies: All rights and remedies provided in these Terms of Service are cumulative and not exclusive of any other rights or remedies that may be available under law or in equity.
13. Assignment
- Restrictions on User Assignment: Users may not assign or transfer any of their rights or obligations under these Terms of Service without the prior written consent of Masjidkit. Any attempted assignment or transfer without such consent will be null and void.
- Masjidkit's Rights to Assign: Masjidkit may assign or transfer its rights and obligations under these Terms of Service without restriction, including but not limited to in connection with a merger, acquisition, or sale of assets.
- Successors and Assigns: These Terms of Service shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
- Notification of Assignment: Masjidkit will provide users with notice of any assignment by posting an update on the platform or through other appropriate means.
- Updates to Assignment Terms: Masjidkit reserves the right to update and change the assignment terms from time to time. Any updates or changes will be communicated to users as specified in Section 9.
